Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Anlyzo (“we,” “us,” or “our”) governing your access to and use of the Anlyzo platform, including our website at anlyzo.com, dashboard, APIs, and related services (collectively, the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Anlyzo is a unified analytics dashboard that allows digital product sellers to connect their selling platforms (such as Etsy, Gumroad, and Shopify) and view aggregated revenue, product performance, trends, and AI-powered business insights in a single interface.

The Service includes:

• Platform connections via OAuth for data synchronization
• Unified dashboard with revenue, product, and trend analytics
• Automated data syncing at regular intervals
• AI-generated weekly business insights
• Configurable alerts and email notifications
• Subscription-based access to premium features

3. Account Registration

To use the Service, you must create an account by providing a valid email address or signing in with Google OAuth. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials and not share them with others
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or remain inactive for more than 12 consecutive months.

4. Platform Connections and Data Authorization

When you connect a third-party platform (e.g., Etsy, Gumroad) to Anlyzo, you:

• Authorize Anlyzo to access your seller data on that platform via their official API, within the scopes you approve during the OAuth flow
• Confirm that you are the authorized owner or administrator of the connected seller account
• Understand that Anlyzo reads data from these platforms but does not modify, create, or delete listings, products, orders, or any other data on the connected platform
• Acknowledge that data availability and accuracy depend on the connected platform's API — we are not responsible for incomplete or delayed data caused by platform outages, API changes, or rate limits

You may disconnect any platform at any time from your Connections page. Disconnecting immediately revokes our access and deletes stored OAuth tokens. Historical data already synced will be retained according to your plan's data retention policy unless you request deletion.

5. Subscription Plans and Billing

5.1 Free Plan

Anlyzo offers a free plan with limited features, including 1 platform connection and 30 days of data history. The free plan is available indefinitely with no credit card required.

5.2 Paid Plans

Paid plans (Pro and Business) are billed on a recurring monthly or annual basis through Stripe. By subscribing to a paid plan, you authorize us to charge the payment method on file at the beginning of each billing cycle.

5.3 Pricing Changes

We may change subscription pricing at any time. Price changes will take effect at the start of your next billing cycle. We will provide at least 30 days' notice of any price increase via email.

5.4 Cancellation and Refunds

You may cancel your paid subscription at any time through your Settings page or the Stripe customer portal. Upon cancellation:

• Your paid features remain active until the end of the current billing period
• Your account will automatically downgrade to the free plan
• Data exceeding the free plan's retention limit (30 days) will be deleted after downgrade

We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us within 14 days of the charge.

5.5 Failed Payments

If a payment fails, we will attempt to charge your payment method up to 3 times over 14 days. If all attempts fail, your subscription will be cancelled and your account downgraded to the free plan.

6. Acceptable Use

You agree to use the Service only for its intended purpose — analyzing your own digital product sales data. You agree not to:

• Connect accounts that you do not own or are not authorized to manage
• Use the Service to scrape, harvest, or collect data about other sellers or their customers
• Attempt to access the Service's infrastructure, databases, or other users' data through unauthorized means
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service in any way that violates the terms of service of connected platforms (Etsy, Gumroad, Shopify, etc.)
• Resell, sublicense, or redistribute your access to the Service or the data provided through it
• Use automated tools (bots, scrapers) to interact with the Service beyond normal API usage
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for any illegal purpose or to transmit malicious code

Violation of these acceptable use policies may result in immediate suspension or termination of your account without notice.

7. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by Anlyzo and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription.

Your data remains yours. We do not claim ownership over any data you import into the Service from connected platforms. You grant us a limited license to process, store, and display your data solely to provide the Service to you.

8. AI-Generated Content

The Service may generate AI-powered business insights and recommendations based on your data. You acknowledge that:

• AI-generated insights are provided for informational purposes only and should not be treated as financial, legal, or professional advice
• The accuracy of AI insights depends on the quality and completeness of the underlying data
• You are solely responsible for any business decisions made based on AI-generated recommendations
• We do not guarantee the accuracy, completeness, or timeliness of any AI-generated content

9. Data Accuracy and Limitations

While we strive to provide accurate analytics, you acknowledge that:

• Data is sourced from third-party platforms and may contain errors, delays, or discrepancies
• Revenue calculations, fee breakdowns, and currency conversions are approximations and may differ from platform-reported figures
• Exchange rates are updated daily and may not reflect real-time rates at the time of each transaction
• Platform API changes or outages may temporarily affect data availability or accuracy
• The Service should not be used as your sole source of truth for tax reporting, financial statements, or legal compliance — always verify with the source platform

10. Service Availability

We aim to provide reliable, uninterrupted access to the Service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to:

• Planned maintenance (we will provide advance notice when possible)
• Infrastructure outages at our hosting providers
• Third-party platform API downtime affecting data syncs
• Force majeure events beyond our reasonable control

We will make reasonable efforts to restore the Service as quickly as possible during any disruption. Extended outages will not automatically entitle you to refunds, but we may offer service credits at our discretion.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, data, or business opportunities
• Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim
• We are not liable for any damages arising from your reliance on AI-generated insights, data inaccuracies from third-party platforms, or business decisions made using the Service

12. Indemnification

You agree to indemnify, defend, and hold harmless Anlyzo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including the terms of service of connected platforms
• Any content or data you provide through the Service

13. Account Termination

By you: You may delete your account at any time. Upon deletion, we will permanently remove all your data, connected account tokens, and personal information within 30 days.

By us: We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use policy
• Your use of the Service poses a security risk or may adversely affect other users
• Required by law or a legal order
• Your account has been inactive for more than 12 consecutive months

Upon termination, your right to use the Service ceases immediately. Sections 7, 8, 9, 11, 12, and 15 shall survive termination.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and delete your account before the changes take effect.

15. General Provisions

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Anlyzo operates, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration body in our jurisdiction.

15.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Anlyzo regarding the Service and supersede all prior agreements.

15.5 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15.6 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without your consent in connection with a merger, acquisition, or sale of assets.
